This privacy statement relates to the personal data collected by Proximities B.V. (hereinafter referred to as: Proximities or we) as controller in accordance with the regulations of the GDPR, during your interactions with Proximities. This is, among other things, the case when you visit our website, purchase services and/or products from Proximities, use products offered by Proximities, subscribe to newsletters or when you contact Proximities.

Processing Personal Data
The following personal data is processed by Proximities:

  • Your name;
  • Your e-mail address;
  • Your home address;
  • Your (mobile) phone number;
  • Your gender;
  • Your date of birth;
  • Other personal data as provided in one of the web forms on our website, such as a web form for
    feedback, a web form for job applications, a web form for posting vacancies, a web form for
    sending an SMS or a web form for correspondence and/or telephone contact;
  • Comments or questions that we have received from you through service-related communication
    and activities;
  • The name and address of the organization you work for;
  • Your job title;
  • Information about the services or products you have purchased from Proximities;
  • Data resulting from customer research;
  • Your use of the Proximities website;
  • Activities on social media channels of Proximities;

Purposes for processing personal data
Proximities requests your consent to share your personal data with Proximities for the following purposes, but not exclusively limited to:

  • Informing you about services and products of Proximities;
  • Sending newsletters and mailings;
  • Answering questions or resolving complaints about services or products of Proximities, as well as
    informing you about their status;
  • Maintaining customer or supplier relations;
  • Facilitating access to information;
  • Evaluating our services through satisfaction surveys;
  • Improving our information and communication;
  • Improving our website(s);
  • Creating personal messages and special offers;
  • Receiving personalized advertisements based on the information you have shared with us or

Legal bases for processing personal data
Proximities requests and documents your personal consent at the start of each processing of your personal data, such as when you subscribe (or unsubscribe) to our newsletter and mailings. Proximities also processes personal data in order to comply with our contractual obligations, to comply with a legal obligation and for legitimate (business) interests.

Our website and third parties
This privacy statement does not apply to websites of any party that is connected to our websites through links, like social media (Youtube, LinkedIn, Facebook and Twitter). Sharing personal data
Proximities shares your personal data with business partners and third parties if this is necessary for the performance of a service or for the delivery of the products you have purchased. These partners include, but are not limited to, suppliers, carriers, website managers and financial administration. If third parties process your data on behalf of Proximities, we contract a processing agreement with the party to ensure the same level of security and confidentiality of all your personal data. Proximities remains solely responsible for these data processing operations.

Proximities only shares your personal data with associated companies or external service providers outside the EEA if legal transfer mechanisms have been respected. Proximities only shares your data with law enforcement authorities and other parties if it is required to do so by law or if it is legally permitted to do so.

Security
Proximities guarantees a level of security for all data that we store that is appropriate to the risks that are involved. To achieve this, we have implemented appropriate technical and organisational security measures to guarantee the integrity, availability and confidentiality of your personal data. We regularly test and check our systems, make periodic backups, apply encryption, work through encrypted connections and maintain a strict confidentiality policy for our screened employees at all times. If data is transferred to a party outside the European Union, an appropriate equivalent level of security also applies here. Proximities also has a thorough procedure in place in the case of a (possible) data breach.

Retention period
Proximities retains your data depending on the purpose for which we received or collect the data and for as long as they are necessary to achieve the purposes described above, unless a legal obligation imposes or permits a longer retention period. Proximities will remove your personal data in a responsible manner when the retention of your personal data no longer necessary is.

Right of access to your personal data
You can contact Proximities by using the aforementioned contact details to obtain information about which personal data Proximities processes from you and to receive a copy thereof. You can have your own personal data corrected or deleted by Proximities, as long as no legal obligations prevent this correction or deletion.

Right to withdraw consent, right to restrict processing, right to object processing and right to data portability
Furthermore, you have the right to withdraw your consent to the processing of personal data at any time, the right to restrict the processing and the right to object to the processing of your personal data by Proximities. In addition, you also have the right to data portability.

Submit request
You address a specified request to Proximities by using the contact details above, stating your name and address. Proximities will check your identity before your request can be executed. No costs are involved in exercising your rights.

Response
Proximities will honour a request within four weeks. In the event of a complex request, Proximities can extend the period from four weeks to a maximum of twelve weeks. Proximities will always indicate the reason for this postponement. In the event of a request for removal, Proximities will remove the personal data as soon as possible, unless and to the extent that the law requires the personal data to be retained or if there are (other) urgent reasons that oppose removal.

Complaint
Proximities assists you in exercising your rights. Should you nevertheless be unable to reach consensus with Proximities, you always have the right to submit a complaint to the Autoriteit Persoonsgegevens (Dutch DPA). More information on this can be found here.
